HIV-Positive Asylum Seeker Has Appeal Rejected
A Ugandan woman who is HIV-positive has seen her bid to stay in the UK rejected by the European Court of Human Rights.
The lawyers of the unnamed woman argued that the poor medical facilities in Uganda would lead their client's early death. This, they said, amounted to cruel and degrading treatment.
However, the court agreed with the government's assertion that all NHS HIV drugs are available in Uganda. The court concluded that it would not be inhuman or degrading to sent the woman back to Uganda.
The woman entered the UK in 1998 under an assumed name and an asylum application was lodged on her behalf by solicitors, claiming government soldiers in Uganda raped her due to her association with the Lord's Resistance Army, a rebel group in the country.
The application was rejected in 2001, and an appeal was launched.
In rejecting her claim, the secretary of state found no evidence that she was of interest to Ugandan authorities and the treatment of Aids in Uganda was comparable to any other African country.
Furthermore, the secretary of state also found that all the major anti-viral drugs were available in Uganda at highly subsidised prices.
