Naval officer has rape sentence quashed
A Royal Navy chief petty officer who was jailed for the rape of a female colleague in March has had his conviction quashed by the Court of Appeal.
Phillip Coates, 30, from Devon, was jailed for five years after being found guilty of raping the woman at a barbecue on a warship at sea.
However, three judges at the Court of Appeal ruled that his conviction was unsafe on Friday.
Mr Coates was not in court to hear the ruling by Sir Igor Judge, Mr Justice Goldring and Mr Justice Beatson.
It is believed that the question of a retrial is under consideration by the prosecuting authority. However, the Court of Appeal would have to make any decision on a second trial.
Mr Coates was also dismissed from the Royal Navy by the court martial panel at Portsmouth's HMS Nelson and was also demoted and deprived of good conduct badges.
The case was believed to be the first where a sailor was convicted of the rape of a female colleague sincce women were allowed to go to sea with the navy.
