Inquest into judge fire death announced

The High Court has ordered a fresh inquest into the death of a judge who died in a fire in his garden shed.

Andrew Chubb, 58, died in the fire at his home near Chard, Somerset, in July 2001.

The fire is understood to have occurred less than an hour after the judge had asked his wife of 34 years, Jennifer for a divorce.

The original inquest had been conducted by the East Somerset Coroner in December 2001 and ruled that the judge's death was accidental. Mrs Chubb had been arrested and interviewed in connection with her husband's death but was never charged.

Mr Chubb's mistress, Kerry Sparrow, had challenged the ruling.

On Wednesday, Lord Chief Justice Lord Phillips and Mr Justice Roderick Evans quashed the first inquest and ordered a new one before a different coroner, saying that new evidence cast doubt on the original verdice.

They said that a fresh investigation might cause "distress" to the judge's family, but said: "Nonetheless, we have concluded that it would be contrary to the interests of justice to leave undisturbed, in a case which has been the subject of wide public interest, a verdict which is based on only part of the relevant evidence - and which the balance of the relevant evidence suggests may be open to doubt."

The High Court said that there was "not a shred of evidence" to support an unlawful killing verdict, but said that suicide was still a possible verdict and justified a new investigation.

Tobin Murder Trial Halted Due To Illness

Top judge cleared of flashing charge
One of Britain's most senior judges has been found not guilty of exposing himself to a woman twice on packed commuter trains. Sir Stephen Richards, a 56-year-old Court of Appeal judge, from south-west London, was alleged to have flashed at the same woman on two trains in the area on October 16 and 24 last year.

Man Extradited From Morocco To Face Four Murder Charges
A 54-year-old man has been extradited from Morocco to appear in court charged with the murders of a family of four at their home in Northampton. Jifeng and Helen Ding and their two daughters, 18-year-old Xing and Alice, 12, were stabbed at their home in Wootton in April 2011.

Rehabbed Gascoigne Misses Sentencing
Ex-World Cup star Paul Gascoigne, 43, has missed his court appearance to be sentenced for drink-driving. The former footballer failed to show because he is in rehab. Last month he admitted driving while being four times over the limit and was due before Newcastle Magistrates' Court.

Brothers' Sentences Overturned
Two brothers, jailed for causing brain damage to an intruder, have had their sentences overturned at the Court of Appeal. Munir Hussain, 53, was freed, after originally being handed down a 30 months jail term for grievous bodily harm with intent. The businessman hit Walid Salem with a cricket bat on 3 September 2008.
