Pc driving acquittal overturned

A police officer who was not convicted for driving at 159mph has had his acquittal overturned by the High Court.

Pc Mark Milton, 38, from Telford, Shropshire, was recorded by the patrol car's video camera while driving on the M54 in the early hours of the morning in December 2003.

He was acquitted by District Judge Bruce Morgan at Ludlow Magistrates' Court last year, after the court heard that he had been trained in advanced driving skills and was "familiarising" himself with the new car.

However, the Director of Public Prosecutions requested the High Court to set aside Judge Morgan's decision.

Two High Court judges, Lady Justice Hallett and Mr Justice Owen, ruled that Judge Morgan had taken irrelevant matters into account when deciding the case, such as testimony from two police officers who had not classed Pc Milton's driving as dangerous.

The case has been sent back to Ludlow Magistrates for a re-hearing.
