Driver loses Selby rail crash appeal
Gary Hart has lost a challenge in Court of Appeal against his conviction over his part in causing the Selby rail crash.
The 38-year-old driver from Strubby in Lincolnshire was jailed for five years for causing 10 deaths by dangerous driving at Leeds Crown Court.
Three Court of Appeal judges rejected Hart’s appeal following a previous attempt to mount an appeal against the June 2002 conviction.
Today the court said that there was “no reason whatever to regard these verdicts as unsafe”.
On February 28 2001, Hart’s 4x4, which was towing a trailer, plunged down an embankment off the M62 motorway onto the main east coast railway line. The wreckage of the vehicle caused the derailment of a southbound express train that in turn collided with a northbound train hauling coal.
Ten people lost their lives in the crash and 76 were treated for their injuries in hospital.
The Court of Appeal findings means that the inquests into the deaths, which had been delayed because of the appeal, may now proceed.
