Brothers' Sentences Overturned
Two brothers, jailed for causing brain damage to an intruder, have had their sentences overturned at the Court of Appeal.
Munir Hussain, 53, was freed, after originally being handed down a 30 months jail term for grievous bodily harm with intent.
The businessman hit Walid Salem with a cricket bat on 3 September 2008.
Mr Hussain and his family had been tied up by three masked intruders at their home in High Wycombe, Buckinghamshire.
Lord Chief Justice Lord Judge said he had shown "mercy" to Mr Hussain by replacing his prison sentence with a two-year suspended term.
His brother, Tokeer Hussain, had his 39-month jail term for causing grievous bodily harm reduced to two years.
Both men were described as being at the heart of the community at their criminal hearing last year.
They were sentenced at Reading Crown Court in December.
Mr Hussain told the court he and his family were confronted by intruders after returning home from their mosque.
The men in balaclavas tied the family up, however Mr Hussain was able to escape and call on his brother.
The brothers then chased the intruders, catching Salem and assaulting him.
Salem was struck so hard on the head with a cricket bat, the piece of wood broke into three pieces.
Lord Judge said the case was one of "true exceptionality".

Man remanded over 'bomb plot'

A British "cyber groomer" has been sentenced to 12 years after recruiting a schoolboy to a "worldwide" holy war against non-Muslims. Aabid Hussain Khan and Sultan Muhammad, both 23, were found guilty of possessing a computer "encyclopaedia" of extremist material.
