COOPER ATTEMPTS TO UNSEAT GILDERNEW
ULSTER Unionist James Cooper has commenced a legal battle in an attempt to unseat new Sinn Fein MP Michelle Gildernew.
The case being brought before the High Court in Belfast claims that a ballot box was interfered with during the course of polling in the Westminster election.
In the Fermanagh South Tyrone Westminster election Sinn Fein candidate Michelle Gildernew narrowly beat Ulster Unionist James Cooper by 53 votes to take the seat.
Cooper’s has brought a case that aims to have him declared the elected MP or to have the result declared void forcing a by-election.
The case is likely to hang on the events at the St Martin’s primary school polling station in Garrison County Fermanagh. The petition alleges that members of Sinn Fein kept the polling station open beyond the allocated time.
The two judges presiding over the case Lord Justice Carswell and Lord Justice McCollum will deal with the case in August.
Should the parties be agree the case will be heard in Belfast, but under relevant laws the case may have to be heard inside the bounds of the Fermanagh constituency.
